Terms & Conditions of Sale and Delivery

• The following Terms and Conditions of Sale and Delivery apply to all Belgium Wine Watchers BVBA special offers. The conditions are available for anyone to consult and are also included on our homepage. A written copy will be sent to you upon request.

• 1. Prices

  All prices are in euros, exclusive of VAT and delivery costs, unless stated otherwise.

• 2. Price changes

  Belgium Wine Watchers BVBA reserves the right to change prices and correct any errors at any time. If a price change affects the order(s) you have placed, you have the right to cancel them without any charge.

• 3. Availability

  All Belgium Wine Watchers BVBA offers are non-binding and subject to availability. Should a product unexpectedly be unavailable, we will inform you and may suggest an alternative. We will contact you by e-mail.

• 4. Photos and illustrations

  Photographs and illustrations on our website are for illustrative purposes only. Actual labels may differ from those shown on the website.

• 5. Foreign orders

  Belgium Wine Watchers BVBA, a Belgian company, is subject to Belgian law, regulations and procedures. If the recipient of our products is not located in the country from which they are dispatched, the recipient is responsible for any sales tax or import duties applicable in the destination country.

• 6. Payment

  Belgium Wine Watchers BVBA only delivers after payment has been received in advance or if cash is paid upon collection. Payment upon receipt of invoice is possible for established customers.

• 7. Deliveries

  The delivery times provided on the website and in the order confirmation are indicative only and do not constitute a binding deadline. Belgium Wine Watchers BVBA cannot be held liable for any damages resulting from delayed delivery.

• 8. Transport

  All our prices exclude transport and insurance costs. Belgium Wine Watchers BVBA is happy to arrange transport for you. We will select a carrier depending on the size and urgency of your order and will provide you with a quotation for approval.

• 9. Complaints

  If, upon receipt, you notice that the delivered product does not correspond to your order, please contact us immediately by e-mail (info@belgiumwinewatchers.com) or by telephone at +32 (0)3 295 60 60. Your complaint will then be handled accordingly.

• 10. Guarantee

  What guarantee do I have if the wine I buy is bad or cork-tainted? As we trade in old and exclusive wines, it is not possible for us to offer any form of guarantee. We always strive to supply products of the highest possible quality; however, it is impossible for us to offer any guarantee for wines older than 10 years.

  With regard to cork-tainted wines, as this defect occurs during the bottling process, we cannot revert to the producer, and therefore we are unable to offer any guarantee in such cases.

• 11. Cancellations

  The right of withdrawal does not apply, as these are sealed products subject to market fluctuations.

• 12. Personal data

  Belgium Wine Watchers BVBA guarantees that your personal details and information will be handled with the utmost confidentiality and will not be shared with third parties.

• 13. Transaction amount

  Please note that the transaction amount will be charged directly to your credit card at the time of the transaction.

• 14. Disputes

  In the event of a dispute, the Courts of Antwerp shall have exclusive jurisdiction. The amount of any potential damages can never exceed the value of the ordered and delivered goods.

  Information regarding alternative dispute resolution can be found via this link: https://commission.europa.eu/index_en. Nevertheless, we reserve the right to submit any disputes exclusively to the courts.

• 15. Cellar 64 Membership

  15.1. Subscription & Fee

  Cellar 64 is an optional premium membership offered by Belgium Wine Watchers BVBA. The subscription fee amounts to €75 per month, unless expressly stated otherwise.

  15.2. Recurring Payment Authorisation

  By subscribing to the Cellar 64 Membership, the customer expressly authorises a monthly recurring payment. The successful execution of the payment constitutes explicit acceptance of this recurring monthly charge.

  15.3. Payment Method & Stripe

  All payments relating to the Cellar 64 Membership are processed exclusively via Stripe, a secure third-party payment service provider. Payments are made using the credit card details provided by the customer at the time of subscription.

  Belgium Wine Watchers BVBA does not store, process or have access to full credit card details at any time.

  By completing the subscription, the customer also agrees to be bound by Stripe’s applicable terms and conditions, which govern the payment transaction.

  15.4. Failed or Refused Payments

  In the event that a monthly payment is refused, reversed or cannot be successfully processed for any reason, Belgium Wine Watchers BVBA reserves the right to suspend or terminate the Cellar 64 Membership with immediate effect, without prior notice or compensation.

  15.5. Cancellation by the Customer

  The customer may cancel the Cellar 64 Membership at any time. The membership will remain active until the end of the current, already paid billing period. No partial or full refunds will be granted for any started billing period.

  15.6. Termination by Belgium Wine Watchers BVBA

  Belgium Wine Watchers BVBA reserves the right to terminate the subscription in case of misuse, breach of these terms and conditions, or non-payment.

  15.7. Liability & Payment Instrument

  Belgium Wine Watchers BVBA acts solely as the beneficiary of the subscription payment and cannot be held liable for any issues, disputes, fraud, misuse or damages related to the customer’s credit card or other payment method. All such matters fall under the responsibility of the cardholder and the payment service provider (Stripe).

  15.8. Price Changes

  Belgium Wine Watchers BVBA reserves the right to modify the subscription fee. Any price change will be communicated in advance and shall only apply to future billing periods.

  15.9. No Investment Advice

  The Cellar 64 Membership and any information, recommendations or wine selections provided by Belgium Wine Watchers BVBA  do not constitute investment advice, nor an offer or recommendation to purchase wine for the purpose of financial return or capital appreciation. All purchasing decisions are made at the customer’s own discretion and responsibility.

  15.10. Applicable Law & Consumer Protection

  These subscription terms are governed by Belgian law, in accordance with Book VI of the Belgian Code of Economic Law concerning market practices and consumer protection.

• 16. Gift Cards & Vouchers

  16.1. Definitions

  • Gift Card / Voucher : a prepaid credit issued by Belgium Wine Watchers BVBA that can be redeemed on the website of Belgium Wine Watchers BVBA.

  • Subtotal : the total price of the products ordered, excluding transport, shipping, insurance, duties, taxes and any additional service costs.

  16.2. Use of Gift Cards & Vouchers

  Gift Cards and Vouchers may only be used to pay (part of) the Subtotal of an order. They cannot be used to cover transport, shipping, insurance or similar additional costs, unless expressly stated otherwise.

  16.3. No Cash Refunds – Replacement Voucher Only

  Orders paid wholly or partially with a Gift Card or Voucher are never refundable in cash or by bank transfer.

  If an order, or part thereof, cannot be fulfilled, Belgium Wine Watchers BVBA will issue a new Gift Card or Voucher with a value equal to the amount of the Gift Card or Voucher actually applied to the Subtotal of that order.

  16.4. Partial Payments

  If an order is partially paid with a Gift Card or Voucher and partially with another payment method, any reimbursement or replacement voucher will be strictly limited to the portion of the Subtotal that was effectively paid with the Gift Card or Voucher.

  Example:
  • Order Subtotal: €100
  • Gift Card used: €25
  • Amount paid via another payment method: €75

  16.5. Validity & Transferability

  Unless otherwise stated on the Gift Card or Voucher:

  • Gift Cards and Vouchers are non-transferable and may not be resold.
  • They cannot be exchanged for cash.
  • They are valid for a limited period as indicated on the Gift Card or Voucher itself.

  16.6. Loss, Theft or Misuse

  Belgium Wine Watchers BVBA cannot be held liable for loss, theft, unauthorised use or misuse of Gift Cards or Vouchers.
